3. Intellectual Property
All content on SESY.AI ecosystem websites — including text, graphics, logos, code, design elements, and brand identity — is the exclusive property of SESY.AI and is protected by applicable intellectual property laws. Unauthorized reproduction or distribution is prohibited.
4. Services & Payments
Professional services are governed by individual Service Agreements. General terms applicable to all engagements:
- Monthly memberships are billed in advance and non-refundable once service has commenced
- Founding member rates are valid for Year 1 and subject to change with 30 days written notice
- Late payments exceeding 15 days may result in service suspension
- All prices are exclusive of applicable taxes (IVA in México; applicable taxes in other jurisdictions)
5. Disclaimer of Warranties
Our websites and services are provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free operation. Results from digital marketing, SEO, or advertising services are not guaranteed, as performance depends on factors outside our control.
6. Limitation of Liability
To the maximum extent permitted by applicable law, SESY.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim shall not exceed the amount paid by you in the three months preceding the claim.
7. Confidentiality
SESY.AI treats all client information, project details, and business strategies as strictly confidential. We do not share client information with third parties without written consent, except as required by law.
8. Third-Party Links
Our websites may contain links to third-party websites. SESY.AI has no control over and assumes no responsibility for the content or practices of any third-party sites.
9. Governing Law & Disputes
These Terms are governed by the laws of the United Mexican States (Código Civil Federal and applicable commercial law). Disputes shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of Quintana Roo, México, unless mandatory law in your jurisdiction requires otherwise. EU users retain all rights granted under applicable EU consumer protection law.
10. Compliance
Our services comply with applicable law in the jurisdictions we operate in, including Mexican federal law (LFPC, LFPDPPP, LISR, LIVA), US regulations (CAN-SPAM, FTC guidelines, CCPA for California residents), Canadian law (CASL, PIPEDA), EU law (GDPR, ePrivacy Directive), and T-MEC/USMCA digital trade provisions.
11. Modifications
We reserve the right to modify these Terms at any time. Material changes will be indicated by updating the "Last updated" date. Continued use of our services after changes constitutes acceptance of the updated Terms.
12. Termination
We reserve the right to terminate or suspend access to our services without prior notice for conduct that violates these Terms or is harmful to other users, third parties, or ourselves.
